THE FACTS
PRINCE Mkwanazi from the Vaal bought a truck from Malitech Engineering for R399 000 in November 2015. He said as part of the agreement, Malitech was supposed to find work that required using his truck, which they did. Prince said a verbal agreement was made that Malitech would deduct the salary for the driver, rent for the trailer, cost for diesel, and 10% of the income generated by his truck per month.
He said the truck operated from December 2015 until it was hijacked in February 2016. Prince added the truck was recovered in the same month in Durban, but the trailer is still missing. He said the truck was taken back to Malitech after recovery and he took it from them at the end of April.
He said he has not been paid for all the trips made by the truck. From the documents provided, the only written agreement is of him renting a trailer from Malitech for R20 520 per month. Prince argued that he does not know how many trips the truck made and how much income has been generated. He wanted help to get the money due to him.
WHAT I DID
I spoke to Scorpion Legal Protection who promised to investigate.
SOLUTION
Scorpion was told that Malitech didn’t know how much is due to Prince as he has never invoiced them. And they don’t know how many trips or loads his truck has transported. They said without an invoice, they will not be able to pay him. The company insists that Prince will only be paid when he provides the invoices. The ball is in his court.
