THE FACTS
Motshweni Johnson said he was dismissed more than two months ago without being given a valid reason.
He was working for Servest Cleaning Company but he and other workers’ contracts were terminated and they were joined another company, Quatro Pro Cleaning Services.
They were on probation for three months.
After a month his supervisor told him their site manager had told her to fire him.
He was not told the reason for his dismissal.
WHAT I DID
I contacted Scorpion Legal Protection for advice on the dismissal.
SOLUTION
Motshweni should have filed a dismissal case at the CCMA within 30 days.
If the 30 day period has lapsed, he should file for condonation and state his reason.
The fact that he was still on probation doesn’t change anything.
Employees on probation still enjoy the same rights as those whose employment has been confirmed.
