THE FACTS
MICHAEL Malapane from Mapetla in Soweto was involved in a car accident. He consulted a lawyer to lodge a claim on his behalf with the Road Accident Fund. When the claim took longer than expected, Michael asked the SunDefender to contact the fund and found out what was causing the delay.
WHAT I DID
I asked the fund’s Boniswa Matshoba to investigate the matter and provide us with an update.
SOLUTION
Boniswa confirmed that a claim was lodged by the lawyer but it didn’t comply with the requirements because a statutory medical report was not included. The claim had, therefore, lapsed because it was not properly lodged within the limited time period.
The claimant is advised to seek independent legal advice with respect to any recourse he may have against the lawyer and the Attorney Insurance Indemnity Fund.
