THE FACTS
MDUDUZI Zuma from Grasmere, in the Vaal worked as a teacher at New Generation Combine. He fell ill and had to take time off work.
When he went back to resume his duties, he claims the principal humiliated him in front of pupils. He allegedly said Mdu was HIV-positive, and ordered him to leave the school before he infected pupils. He was apparently dismissed without pay.
WHAT I DID
I contacted Scorpion Legal Protection for advice regarding Mduduzi’s case.
SOLUTION
Scorpion Legal advised Mduduzi to lodge a complaint with the Commission for Conciliation, Mediation and Arbitration.
This should be done within 30 days. If this 30-day period has expired, he can apply for condonation, stating the reasons for the delay. If the condonation is accepted, the CCMA will schedule a hearing date.
