MALETSATSI Hlapane from Sebokeng in the Vaal said she worked for a doctor for 22 years. He said he was retiring. She managed to get another job but, to this day, the doctor is still practising. He never paid his staff anything for all the years they worked for him.
WHAT I DID
I contacted Scorpion Legal Protection for advice on a way forward for Maletsatsi.
SOLUTION
The doctor should have terminated their employment with severance pay. In this case the employer was alleging operational requirements so section 189 applies, which states that on termination of employment the employer must pay his employees retrenchment benefits. Maletsatsi should apply for UIF benefits at the department of labour and for her provident funds from the relevant provident fund administrator.
