THE FACTS

LANGA Mbuyiseni from Honeydew, Joburg has been working at a restaurant in the city for more than eight years.

He claimed that since he wasn’t registered he wasn’t allowed to take leave, nor was he paid overtime.

He said he reported the matter to the department of labour and they sent an inspector, but to date nothing has changed.

WHAT I DID

I contacted Scorpion Legal Protection.

SOLUTION

The Basic Conditions of Employment Act stipulates that employees are entitled to leave and that working hours should be 45 hours in a week. If that period is exceeded, overtime must be paid.

Langa needs to follow up with the department on the progress of the inspector’s investigation. He needs to go there with his ID to enable them to check the facts.
