BOOI Yangapi was employed at Bon Appetit as a driver for six years when he was hijacked and stabbed while driving a company car. His employer refused to sign compensation forms, and he discovered he was not registered as an employee with the Department of Labour.
WHAT I DID
I spoke to Scorpion Legal Protection to find out what could be done in Booi’s case.
SOLUTION
When an employee is injured at work and claims for compensation, the employer must report the accident within seven days, in terms of the Compensation for Occupational Injuries and Diseases Act. An employer who fails to do this is guilty of an offence and may be held liable for full compensation payable in respect of the accident.
Booi must report the matter to the department and will be provided with a letter to give to the
employer, or appoint an inspector.
According to the law, if an employee works for more than 24 hours a month he has to be registered.
Because Booi is not registered, he must report the case to the department to ensure compliance by the employer.
