THE FACTS
Ernest Siphethu said he was fired for reporting a colleague to management at the company he worked for. He was supposed to go for a hearing but he said he was not notified of the date and was insulted and chased off the premises instead.

SOLUTION
Ernest Siphethu was dismissed from work on 5 February last year after being charged with misconduct for insulting a colleague.
The bargaining council awarded him a default reinstatement which was taken on review and the dismissal was ruled to be fair.
Ernest received an SMS on 28 August to say he’d lost the case. He had six weeks to respond, which have expired, and he will have to apply for condonation.
The client was represented by a union and Scorpion advised him to approach the union to help him.
Ernest said he is in KZN and will contact the union when he returns to Joburg at the end of January.
