THE FACTS

CYNTHIA Xaba from Protea North, Soweto said when she met her husband he was divorced.

He decided to buy his wife’s share of the house they owned before the divorce.

However, the title deed was not changed and still had both names on the document.

Cynthia married him but they lived in the house with his former wife. Later the husband reconciled with his ex and they moved out of the house. Cynthia was left alone in the house but was still officially married.

She recently discovered that her husband intended to sell the house and wanted to know if he was allowed to do it. She came to SunDefender for help.

SOLUTION

If she was married in community of property, Cynthia will have to sign an offer to buy the house if she wants it.

Her husband can’t sell the house without her consent if they are married in community of property. She can get a high court order to stop him.
