THE FACTS

FREDDY Morudu from Chiawelo, Soweto, said his wife fell pregnant in 2016. In her sixth month there were complications and she went into premature labour. The baby was confirmed as healthy but was incubated due to being premature. At midnight, he was contacted by the hospital and told the baby had died. He was told the baby had consumed its own faeces before delivery. He suspects negligence on the part of the staff and wants to take action against the health department.

WHAT I DID

I spoke to Scorpion Legal Protection to get legal advice.

SOLUTION

A Scorpion Legal attorney said Freddy will have to prove that doctors attending his child were negligent. An expert will look at the post mortem, the birth report, the child’s and mother’s medical records and the doctor’s notes. If there was negligence, Freddy can appoint an attorney to take civil action against the department.
