THE FACTS

CATHERINE Mangxaba fro m Dawn Park, Ekurhuleni said she was divorced in 2009.

According to the divorce order, the joint estate would be split between Catherine and her ex-husband, including their pension funds.

Her ex-husband was meant to pay R3 000 a month for maintenance, but is only paying R1 000 a month and is still living in the house they bought together. He refuses to sell it so the money can be shared. Catherine also worries that she did not receive her full share of the pension money.

WHAT I DID

I called Scorpion Legal Protection to assist her.

SOLUTION

Catherine will h a ve to hire an attorney to help her apply to enforce the divorce order through the court.

The order will force her ex-husband to act according to the original order.

As far as the pension money goes, she only was entitled to 50% of the amount that came into the fund while they were married, not the whole sum.

If she wants the fund administrators to show her how much came in while they were married, she needs a court order for the trustees to make that information
available.
