The client was involved in an accident and his phone was damaged. According to the protection plan he took with Jet Stores he is eligible for a phone. Jet wanted us to provide them with power of attorney to proceed with the matter.
Injustice
On 20 January Scorpion consulted with the client who said he bought a cell phone at Jet stores. Client was hit by a vehicle and lost his cell phone at the scene of the accident. The cell phone was insured.
Azikhiphi
The client said the insurance never replaced his cell phone. Scorpion called Jet Stores and spoke to Semakaleng, the consultant, who advised there is a cell phone contract claim on the system but it appears the claim was paid. She said she can’t view the details about the extent of the cover. She said sometimes the insurer will pay-off the balance on the cell phone account and in other cases the insurer will replace the cell phone and the client is expected to carry on paying his account. Unfortunately the client does not have a schedule of insurance.
Can the client strike back legally?
The consultant suggested the client must visit the nearest Jet Store to ask about the type of cover. The client went to Jet but they couldn’t provide him with a schedule of insurance because his account was closed a long time ago. They said the type of insurance he was covered for is for settlement of outstanding balance on the account and not cell phone replacement. Client confirmed his account was paid off after he submitted an insurance claim. The client was advised it would be difficult to challenge the version of the retailer.
No further assistance can be given to the client as he does not have a schedule of insurance to prove he is entitled to a replacement phone.
